Himalayan Walkers Pvt.Ltd. is an adventure and tourism company specializing in trekking and tour, is situated in Nepal. As a local trekking and travel agency, it operates within the legal framework of the Nepal Tourism Industry. Himalayan Walkers Pvt.Ltd. is a reputable and officially registered company that welcomes your bookings according to the stipulated terms and conditions.

 

1. Introduction:

The term "Trip" encompasses various offerings listed on our website, such as trekking, hiking, climbing, sightseeing tours, mountaineering, luxury tours, expeditions, helicopter tours, and adventure tour programs available in Nepal, India, Bhutan and Tibet. Upon reviewing and confirming your booking, our company will promptly send you an email to notify you that your trip has been successfully booked and accepted. This email confirmation serves as the quickest method to confirm your reservation and guarantees the definite arrangement of your trip starting from that date.

2. All bookings are made with Himalayan Walkers P. Limited, Registered Company Number 140204/072/73(hereinafter referred to as The Company) whose registered office is The Dharmasthali, Kathmandu, Nepal. The Head of The Company is Suresh Dhakal.

 

3. Regarding contract information

When you make a reservation with Himalayan Walkers, you enter into a contractual agreement with the company. This contract serves as a mutual agreement between both parties and outlines the terms and conditions governing the trip. It's important to be aware that the company retains the right to modify the listed brochure price, either increasing or decreasing it, prior to confirming the booking.

Please bear in mind that the company is unable to provide any warranties, additional agreements, or descriptions of services or conditions beyond what is explicitly stated in the contract. The terms and conditions specified in the agreement take precedence over any previous agreements or understandings between the client and the company. Consequently, it is highly advisable for clients to thoroughly read and comprehend the terms and conditions of the contract prior to confirming their booking. This ensures that both the company and the client have a clear understanding of the trip itinerary, cost, and any other pertinent details.

 

4. Book with 25% deposit payment

In accordance with the company policy, in order to secure the booking of any trip, a non-refundable down payment of 25% of the total trip cost must be made in advance. This deposit is necessary to ensure confirmed reservations for hotels in the city, domestic flights, and all other arrangements related to the final trip booking. In addition to the deposit, we require a detailed list of participant names (matching their passports), gender, and nationality, date of birth, passport number, passport issue/expiry dates, and profession. For all trips in Nepal, Tibet, and Bhutan, you will need to send us a copy of your passport either by fax or attached to an email.

We provide the option of making secure online payments directly through credit cards or bank transfer.

 

5. Payment Methods

After receiving the confirmation from Himalayan Walkers Pvt.Ltd. regarding your desired trip, the subsequent step is to proceed with the payment in accordance with the company's policy. Payments can be made through either bank transfer or online credit card payment. When transferring funds through any payment method, it is crucial to provide precise and comprehensive information. It should be noted that full payment is mandatory for helicopter tours, as well as tours in India, Bhutan, and Tibet. Upon confirming your booking, the company will furnish additional information regarding the payment process through email.

A. Online payment by cards:

We take pleasure in providing our clients with the ease and convenience of online payment for their trips, utilizing credit cards. Recognizing the significance of safety and security in online transactions, we have implemented a highly secure international payment gateway. This guarantees the protection of your personal and financial information during the payment process. With Himalayan Walkers, you can be confident that your payment transaction will be conducted in a secure and safeguarded manner.

B. Bank Transfer:

We are delighted to offer you the bank details required for making the payment for your trip. If you would like to receive this information, please get in touch with us via email or phone, and we will swiftly provide you with the necessary details to securely transfer your funds. Bank transfers serve as a convenient and reliable method for making payments. 6. Full payment

For the majority of Nepal treks, tours, and expeditions, the remaining payment is expected to be settled on the day of arrival. We request rest 75% of the payment to be made on cash USD on your arrival day, however we offer payment by bank transfer or credit cards. In the case of card payment, 4% payment processing fee will be applicable from bank. Nevertheless, there may be circumstances where we will request full payment prior to your arrival, particularly for trips in Tibet and Bhutan as well as Heli Tour. It is important to be aware that failure to make the full payment within the specified time or on the arrival day may result in the cancellation of your trip, as we reserve the right to do so.

 

7. Last minute bookings

Himalayan Walkers gladly accommodates last-minute bookings for clients who were unable to secure a regular trip due to various reasons. To facilitate this, the company has established a special booking provision for Nepal trips, allowing for last-minute bookings with the requirement of 100% trip payment in advance or on arrival day. However, it's important to note that last-minute bookings for Tibet and Bhutan trips cannot be accommodated. Additionally, please be aware that all last-minute bookings are subject to availability, and it is advisable to inquire promptly to secure your desired trip.

 

8. Our holiday tour and trek packages include accommodations in rooms or tents on a twin sharing basis. Consequently, clients who do not have another tour participant to share a room or tent with will be subject to a single room supplement charge.

 

9. Cancellation Policy

We acknowledge that unforeseen circumstances can arise, including weather-related delays or trip cancellations beyond our or our clients' control. In such situations, we have specific conditions under which we offer reimbursement of the advance payment. Various factors, such as religious, cultural, economic, political, and social influences, can contribute to the cancellation of a trip. It is possible that local government authorities may restrict participation in any form of trip during these circumstances, and Himalayan Walkers Pvt.Ltd. cannot be held accountable for such limitations. We strongly advise our clients to heed the advice provided by our guides, Sherpas, and local residents regarding weather conditions and trail assessments. Failure to adhere to such advice may lead to personal harm or health risks for which we cannot assume responsibility.

A. Cancellation of the trip by clients:

If you need to cancel your trip, and you have already made full payment, you may be eligible for a refund. However, it is essential to notify Himalayan Walkers Pvt.Ltd. in writing regarding your cancellation, and the company must acknowledge this notification. In the event of a cancellation, the company retains the right to apply a cancellation charge, which will be a percentage of the total cost indicated on the trip cost listed in the website brochure.

Before 30 days from the date of your trip start:   25% of the full amount.

Less than 30 days from the date of your trip start: 45% of the full amount.

Kindly be aware that clients who choose to voluntarily withdraw from the journey, regardless of the reason, once the trip has commenced, will not be eligible for any refunds of the trip cost. Moreover, no refunds will be issued for any unused portions of the itinerary, including accommodation, transportation, sightseeing, meals, or other services that were not utilized by the clients. It is advisable to thoroughly review the cancellation policy and carefully consider it before making any bookings.

B. Cancellation of the trip by company:

In the event of a trip cancellation, the company reserves the right to cancel your booking unless it has been guaranteed to operate. If the company cancels a trip due to circumstances beyond its control, such as natural disasters, flight cancellations, or government intervention, it will provide a refund for the trip price only. The same refund policy applies if the company cancels your guaranteed departure trip, and you have the option to choose an alternative trip of equal value. However, significant changes such as alterations to airline carriers, flight schedules, itineraries, vessel substitutions, changes in cabin category or hotel accommodation are excluded from this policy, as long as the departure and arrival dates remain unchanged and the new arrangements are of the same category.

In the event that you are unable to appear at the designated meeting point on the agreed-upon date, we will assume that you have experienced a delay and will anticipate your contact regarding your revised expected arrival date. However, if we do not receive any communication from you within 48 hours, it will be understood that you have decided to cancel the tour. In such cases, no refund will be provided for any funds already paid.

It is important to be aware that the company is not responsible for any incidental expenses or losses incurred, such as visa fees, non-refundable flights or rail tickets, vaccination costs, non-refundable car parking fees, or any other fees. Additionally, the company cannot be held liable for the loss of personal belongings resulting from the trip booking.

 

10. Special or medical requirement

Clients must provide written notification to the company regarding any physical conditions that could impact their ability to travel, including medical or mental health conditions. Failing to disclose such information at the time of booking may lead to the client being denied travel and incurring a cancellation fee of 100%.

When planning a trip, it is crucial to consider factors such as age, mobility, pregnancy, and physical and mental well-being. Clients should ensure their comfort with the trip prior to making a booking. While the company will strive to accommodate special requests, such as dietary requirements, it is important to note that these requests do not form part of the contract, and the company cannot be held liable for any failure to fulfill them.

Additionally, it is worth noting that medical facilities may vary from one country to another. The company does not make any representations or warranties regarding the quality of medical treatment available at the destination.

 

11. Regarding trip amendment

In case of any undesirable circumstances that arise at the start of the trip, clients may need to amend their itinerary. This may be due to factors beyond our control such as weather conditions or landslides. The company will inform clients promptly in such situations. If clients wish to make amendments for personal reasons, they must submit a written request for a trip amendment to the company. The company will make the necessary arrangements and the following fee structure will apply:

  • For amendment requests made 30 days or more before the original trip departure, a fee of US $75 per person will be charged.
  • For amendment requests made less than 30 days after the original trip departure, charges will be applicable as per the cancellation fees.
  • For amendments made within 10 days of the trip departure, the cost may be higher depending on the arrangements made by the company with other parties such as airlines, hotels, guest houses or operators of various activities.

Please note that any changes in the trip price from the time of the original booking to the time of the amendment will result in a new trip price. Additionally, fees may depend on any charges imposed by hotels or other suppliers to the company."

Please note that mountain adventures are often influenced by unpredictable conditions, especially in mountainous regions where bad weather can lead to domestic flight delays. In the event of a delay in your domestic flight, Himalayan Walkers Pvt. Ltd. will cover the expenses for accommodation (guest house) and meals (breakfast and lunch) in the departing city before your trip commences. However, if your return flight is delayed, any additional expenses such as food and accommodation will be your responsibility. Should you choose to arrange alternative transportation, such as a helicopter flight, to avoid flight delays, you will be responsible for covering all associated costs. It's important to understand that Himalayan Walkers Pvt. Ltd. cannot be held accountable for any expenses incurred due to missed international flights. However, we will do our best to assist you in arranging alternative options whenever possible. Please also be aware that unforeseen circumstances may necessitate changes to the itinerary while you are on the trip.

 

12. The trek information sheets and dossier provided contain important details and terms regarding the tour, and they are considered integral to the contract. It is essential for you to thoroughly understand their contents. However, please note that the itinerary serves as a guide to what the group aims to achieve but is not a binding obligation. Changes may occur due to exceptional weather, flight cancellations, illness, or other unforeseen circumstances. In such cases, no refunds are provided for unused services or unfulfilled expectations. While we sympathize with any disappointment caused, we are unable to offer refunds for these situations.

 

13. Travel Insurance

When embarking on a journey in the remote regions of Himalayan countries, there exists a risk of adverse weather conditions, landslides, floods, and other unforeseen circumstances that are beyond our control. Despite our efforts to minimize these risks, accidents can still happen. Therefore, it is essential to possess travel insurance that offers coverage for the entire duration of your trip.

Your insurance policy should provide sufficient protection for accidents, injuries, illnesses, and even unfortunate events resulting in death. It should also cover medical expenses, emergency repatriation (including helicopter rescue and air ambulance when necessary), and personal liability. Additionally, it is advisable to have coverage for trip cancellation, trip curtailment, loss of luggage, and personal belongings.

You are required to carry proof of insurance and present it upon the company's request. Failure to provide evidence of insurance when requested may lead to the cancellation or suspension of your participation in the trip, without any entitlement to a refund.

 

14. Himalayan Walkers maintain the right to modify the pricing rates displayed on our website due to various factors beyond our control, such as changes in exchange rates or government regulations. However, we strive to maintain the current rates as much as possible. If there are slight increases in flight fares, hotel charges, or other relevant factors, we will not revise the cost of a trip that has already been confirmed and booked with a deposit.

 

15. The tour/trek guide appointed by Himalayan Walkers holds full authority during your tours. If you engage in any illegal activities, it is mandatory for you to discontinue the tour. In such cases, no refund will be provided.

 

16. While we make every effort to ensure your comfort during travel, it is important to recognize that the facilities available in the Himalayan countries may not match those found in affluent Western countries. Additionally, weather conditions can directly impact your journey. Therefore, it is crucial to maintain patience, enthusiasm, and adequately prepare yourself before embarking on the journey.

 

17. Passport and Visa information

In order to have a smooth and stress-free experience with Himalayan Walkers Pvt.Ltd., it is essential for clients to possess a valid passport and obtain the required visas. We recommend that the passport remains valid for a minimum of 6 months beyond the duration of the trip. Please be aware that failure to possess the correct visa documentation may result in entry being denied to a particular country or destination, and the company cannot be held accountable for such situations. Upon arrival in Nepal, a visa can be obtained at the airport. Should you require a visa for Tibet or Bhutan, the company can assist in making the necessary arrangements upon request. For travel to India, clients must obtain a visa from their home country. It is the client's responsibility to ensure that they possess all the necessary travel documents for the trip.

 

18. Himalayan Walkers Pvt.Ltd. cannot be held liable for any injuries, illnesses, emotional distress, or other conditions that clients may encounter during their trip. It is important to note that our package cost does not include personal insurance, so we strongly advise guests to obtain comprehensive travel insurance that covers medical emergencies and helicopter evacuation if necessary. In the event of an emergency, all expenses related to medical treatment, evacuation, and transportation are the responsibility of the client.

Please be aware that the terrain and activities in the Himalayan regions can be physically demanding and carry inherent risks. It is the client's responsibility to assess their own fitness level and ability to participate in the activities outlined in the itinerary. The company retains the right to refuse participation or exclude any client from activities if it is determined that their health or safety may be at risk.

 

19. Please note that when embarking on trekking adventures in remote areas of the Himalayas, it is important to have a reasonable level of physical fitness. Prior to making travel plans to Nepal, it is highly advised to seek advice from a medical professional. It is also crucial to inform the company about any pre-existing medical conditions or disabilities that could potentially increase the likelihood of requiring medical attention and impact your ability to travel. By providing this information, we can ensure appropriate arrangements and necessary precautions are taken to support your journey.

 

20. For travelers who are below the age of sixteen, it is essential to have a legal guardian accompanying them throughout the trip. This requirement is in place to prioritize the safety and overall welfare of the young travelers during their journey. Moreover, the company communicates specific details regarding age restrictions and the suitability of the trip through email correspondence. It is highly advised for the legal guardian to thoroughly review this information and carefully assess whether the trip is suitable for the young traveler before proceeding with the booking.

 

21. You acknowledge that throughout the duration of the trip, various events may occur, such as accidents or illnesses in remote areas where medical facilities may be limited, political instability, and natural forces. You agree to accept and bear all the risks associated with the journey to the fullest extent allowed by the laws of Nepal.

 

22. You recognize that Himalayan Walkers Tours and Treks collaborates with a network of companies, government agencies, and individuals to facilitate the organization and execution of its tours, treks, walks, holidays, and expeditions. While Himalayan Walkers strives to ensure the competence of these third parties in fulfilling their contractual obligations, the company cannot be held responsible for any injury, damage, loss, delay, or other issues that may arise as a result of the actions or behavior of these third parties.

 

23. We extend a unique discount of 10% per person on the listed brochure price for international group leaders who intend to organize a trip to Nepal with a minimum of 5 members. Please note that this discount is exclusively available for groups with 5 or more members and is not applicable to individuals or groups with fewer than 5 members. At Himalayan Walkers, we cater to groups of all sizes and provide personalized services to ensure an exceptional experience. Furthermore, we offer special rates for international agencies seeking collaboration and coordination for Nepal trips.

 

24. The company reserves the right to utilize photographs captured by clients during the journey for publicity and promotional activities across various platforms, without prior notification or compensation. Should you prefer not to have your images taken, it is your responsibility to inform the company ahead of time. Please be aware that these photographs may be utilized in different ways, such as in brochures, websites, social media, and advertisements.

 

25. When you share personal information with Himalayan Walkers while making a reservation, it is solely for the purpose of acquiring the necessary details to facilitate your trip. The company values your privacy and will not utilize any private or personal information for any other reasons without your consent. Your personal information will be treated as confidential and secure, and will not be revealed to any third party except for the purpose of facilitating your trip or when mandated by law.
